James Speed’s Opinion on the Constitutional Power of the Military to Try and Execute the Assassins of the President, Speed was the brother of Lincoln’s “most intimate friend,” Joshua Fry Speed.
As Attorney General to President Andrew Johnson, Speed advises the that, as Commander in Chief, the President has the legality to try the Lincoln conspirators through military courts. This is a topic that is still debated today.
